答 《勞動(dong)(dong)合(he)(he)同(tong)法》第十九(jiu)條規定(ding)(ding):“勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)限(xian)(xian)(xian)三(san)(san)個(ge)月(yue)以(yi)(yi)上不(bu)(bu)滿一(yi)年(nian)(nian)的(de)(de),試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得超過一(yi)個(ge)月(yue);勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)限(xian)(xian)(xian)一(yi)年(nian)(nian)以(yi)(yi)上不(bu)(bu)滿三(san)(san)年(nian)(nian)的(de)(de),試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得超過二個(ge)月(yue);三(san)(san)年(nian)(nian)以(yi)(yi)上固(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)(xian)和無固(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)(xian)的(de)(de)勞動(dong)(dong)合(he)(he)同(tong),試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得超過六個(ge)月(yue)。同(tong)一(yi)用(yong)(yong)(yong)人(ren)單(dan)位與同(tong)一(yi)勞動(dong)(dong)者(zhe)只能約(yue)定(ding)(ding)一(yi)次試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)。以(yi)(yi)完成(cheng)一(yi)定(ding)(ding)工作任務(wu)為期(qi)(qi)限(xian)(xian)(xian)的(de)(de)勞動(dong)(dong)合(he)(he)同(tong)或者(zhe)勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)限(xian)(xian)(xian)不(bu)(bu)滿三(san)(san)個(ge)月(yue)的(de)(de),不(bu)(bu)得約(yue)定(ding)(ding)試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)。試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)包含在勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)限(xian)(xian)(xian)內。勞動(dong)(dong)合(he)(he)同(tong)僅(jin)約(yue)定(ding)(ding)試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)的(de)(de),試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)成(cheng)立,該期(qi)(qi)限(xian)(xian)(xian)為勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)限(xian)(xian)(xian)。”
