答 首(shou)先(xian)勞(lao)(lao)動(dong)者(zhe)在(zai)該用(yong)人(ren)單位連(lian)續工(gong)作滿十年的,用(yong)人(ren)單位初(chu)次實行勞(lao)(lao)動(dong)合(he)同制度或國有(you)企業改制重新(xin)訂立勞(lao)(lao)動(dong)合(he)同時(shi),勞(lao)(lao)動(dong)者(zhe)在(zai)該用(yong)人(ren)單位連(lian)續工(gong)作滿十年且距法(fa)定(ding)退休(xiu)年齡不(bu)足十年的。其(qi)次連(lian)續訂立二(er)次固定(ding)期限(xian)勞(lao)(lao)動(dong)合(he)同。最后用(yong)人(ren)單位自用(yong)工(gong)之日起滿一年不(bu)與(yu)勞(lao)(lao)動(dong)者(zhe)訂立書面勞(lao)(lao)動(dong)合(he)同的,視為用(yong)人(ren)單位與(yu)勞(lao)(lao)動(dong)者(zhe)已訂立無(wu)固定(ding)期限(xian)勞(lao)(lao)動(dong)合(he)同。
