答 首(shou)先勞(lao)動(dong)者(zhe)在該(gai)用(yong)人(ren)(ren)(ren)單(dan)位連續(xu)(xu)工作(zuo)滿十(shi)(shi)(shi)年(nian)(nian)的,用(yong)人(ren)(ren)(ren)單(dan)位初次(ci)(ci)實行勞(lao)動(dong)合(he)同(tong)(tong)制(zhi)度或(huo)國(guo)有企(qi)業改制(zhi)重新訂(ding)立(li)勞(lao)動(dong)合(he)同(tong)(tong)時,勞(lao)動(dong)者(zhe)在該(gai)用(yong)人(ren)(ren)(ren)單(dan)位連續(xu)(xu)工作(zuo)滿十(shi)(shi)(shi)年(nian)(nian)且(qie)距法定退休年(nian)(nian)齡不(bu)足十(shi)(shi)(shi)年(nian)(nian)的。其次(ci)(ci)連續(xu)(xu)訂(ding)立(li)二(er)次(ci)(ci)固定期(qi)(qi)限(xian)勞(lao)動(dong)合(he)同(tong)(tong)。最后用(yong)人(ren)(ren)(ren)單(dan)位自用(yong)工之日(ri)起(qi)滿一年(nian)(nian)不(bu)與勞(lao)動(dong)者(zhe)訂(ding)立(li)書面勞(lao)動(dong)合(he)同(tong)(tong)的,視為用(yong)人(ren)(ren)(ren)單(dan)位與勞(lao)動(dong)者(zhe)已訂(ding)立(li)無固定期(qi)(qi)限(xian)勞(lao)動(dong)合(he)同(tong)(tong)。
