在什么情況下試用期期間會被辭退呢?
問 我在(zai)一家企業上班,剛剛面試上,還在(zai)試用(yong)(yong)期,我想問(wen)一下(xia),在(zai)什么情(qing)況下(xia)試用(yong)(yong)期期間會被辭(ci)退呢?
答 1、在(zai)試用(yong)期間被證明不(bu)符合錄用(yong)條(tiao)(tiao)件的(de); 2、嚴重(zhong)違反用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)的(de)規章制度的(de); 3、嚴重(zhong)失(shi)職,營私舞弊,給用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)造(zao)成(cheng)(cheng)重(zhong)大(da)損害的(de); 4、勞(lao)(lao)動(dong)(dong)(dong)者(zhe)同時與其(qi)他(ta)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)建立(li)勞(lao)(lao)動(dong)(dong)(dong)關系,對完成(cheng)(cheng)本單(dan)(dan)位(wei)(wei)(wei)的(de)工(gong)作任務造(zao)成(cheng)(cheng)嚴重(zhong)影響(xiang),或者(zhe)經用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)提出(chu),拒不(bu)改正的(de); 5、《勞(lao)(lao)動(dong)(dong)(dong)合同法》第二十六條(tiao)(tiao)第一款第一項規定(ding)的(de)情(qing)形致使勞(lao)(lao)動(dong)(dong)(dong)合同無(wu)效的(de); 6、被依(yi)法追究刑事責任的(de)。 7、勞(lao)(lao)動(dong)(dong)(dong)者(zhe)患病(bing)或者(zhe)非因工(gong)負(fu)傷,在(zai)規定(ding)的(de)醫療期滿(man)后不(bu)能(neng)從事原工(gong)作,也不(bu)能(neng)從事由(you)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)另行安排的(de)工(gong)作的(de); 8、勞(lao)(lao)動(dong)(dong)(dong)者(zhe)不(bu)能(neng)勝任工(gong)作,經過(guo)培訓或者(zhe)調(diao)整(zheng)工(gong)作崗位(wei)(wei)(wei),仍不(bu)能(neng)勝任工(gong)作的(de)。
