用人單位在試用期內能否隨意辭退員工?

答(da) 根據(ju)《勞(lao)(lao)(lao)(lao)動(dong)(dong)法(fa)(fa)》第(di)二十五條(tiao)規定,勞(lao)(lao)(lao)(lao)動(dong)(dong)者在試用(yong)期(qi)間被證明(ming)不符合(he)(he)錄用(yong)條(tiao)件(jian)的,用(yong)人(ren)單位(wei)可以解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong),法(fa)(fa)律規定得很清楚,用(yong)人(ren)單位(wei)可解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)的條(tiao)件(jian)是其必須舉(ju)證證明(ming)勞(lao)(lao)(lao)(lao)動(dong)(dong)者在試用(yong)期(qi)間不符合(he)(he)錄用(yong)條(tiao)件(jian),這實(shi)際上(shang)是限制了用(yong)人(ren)單位(wei)隨意(yi)解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong),增加了用(yong)人(ren)單位(wei)的舉(ju)證責任,如果用(yong)人(ren)單位(wei)沒有證據(ju)證明(ming)勞(lao)(lao)(lao)(lao)動(dong)(dong)者在試用(yong)期(qi)間不符合(he)(he)錄用(yong)條(tiao)件(jian),用(yong)人(ren)單位(wei)就不能解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong),否則,需承擔(dan)因違法(fa)(fa)解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)所帶來的一(yi)切法(fa)(fa)律后果。
