答(da) 《勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第十一(yi)條用(yong)人單位(wei)未在用(yong)工(gong)的(de)(de)同(tong)(tong)時訂立書(shu)面勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong),與勞(lao)(lao)動(dong)(dong)者(zhe)約定(ding)的(de)(de)勞(lao)(lao)動(dong)(dong)報酬不(bu)明確的(de)(de),新招用(yong)的(de)(de)勞(lao)(lao)動(dong)(dong)者(zhe)的(de)(de)勞(lao)(lao)動(dong)(dong)報酬按照(zhao)集(ji)體合(he)(he)同(tong)(tong)規定(ding)的(de)(de)標準執行;沒有(you)集(ji)體合(he)(he)同(tong)(tong)或者(zhe)集(ji)體合(he)(he)同(tong)(tong)未規定(ding)的(de)(de),實行同(tong)(tong)工(gong)同(tong)(tong)酬。用(yong)人單位(wei)自(zi)用(yong)工(gong)之(zhi)日起滿一(yi)年不(bu)與勞(lao)(lao)動(dong)(dong)者(zhe)訂立書(shu)面勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de),視為用(yong)人單位(wei)與勞(lao)(lao)動(dong)(dong)者(zhe)已(yi)訂立無固定(ding)期限(xian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。
