答(da) “勞(lao)動(dong)(dong)合(he)同(tong)(tong)當(dang)(dang)(dang)事人按照《條例》第十四條的(de)規定(ding),約(yue)定(ding)的(de)服務(wu)(wu)(wu)期限(xian)長于(yu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)期限(xian)的(de),勞(lao)動(dong)(dong)合(he)同(tong)(tong)期滿(man)由用人單位終止(zhi)合(he)同(tong)(tong)的(de),不得追索勞(lao)動(dong)(dong)者(zhe)服務(wu)(wu)(wu)期的(de)賠償責任。勞(lao)動(dong)(dong)合(he)同(tong)(tong)期滿(man)用人單位要(yao)求勞(lao)動(dong)(dong)者(zhe)繼續(xu)履(lv)行(xing)(xing)服務(wu)(wu)(wu)期的(de),雙(shuang)方當(dang)(dang)(dang)事人應(ying)當(dang)(dang)(dang)續(xu)訂勞(lao)動(dong)(dong)合(he)同(tong)(tong),對服務(wu)(wu)(wu)期的(de)履(lv)行(xing)(xing)方式雙(shuang)方有約(yue)定(ding)的(de),從其約(yue)定(ding)。勞(lao)動(dong)(dong)者(zhe)違(wei)反服務(wu)(wu)(wu)期約(yue)定(ding)的(de),應(ying)當(dang)(dang)(dang)承擔違(wei)約(yue)責任。
