試用期內職位被撤銷怎么辦?
問 我(wo)(wo)面試的是公(gong)司的市(shi)場經理一職,但是在試用(yong)期期間部門撤(che)銷(xiao),我(wo)(wo)的職位也撤(che)銷(xiao)了,我(wo)(wo)該(gai)怎(zen)么辦啊?
答 《中華人民共(gong)和國勞(lao)(lao)動(dong)法》第(di)二十六條和《中華人民共(gong)和國勞(lao)(lao)動(dong)合同(tong)法》第(di)四十條都規定,“勞(lao)(lao)動(dong)合同(tong)訂(ding)立(li)時(shi)所依據的客(ke)觀(guan)情況發生重大變化,致使勞(lao)(lao)動(dong)合同(tong)無(wu)法履行,經用人單位與勞(lao)(lao)動(dong)者協(xie)商,未(wei)能就變更勞(lao)(lao)動(dong)合同(tong)內容(rong)達成協(xie)議(yi)的”,公(gong)司可(ke)以提前一(yi)(yi)個月(yue)(yue)書面(mian)通知,解(jie)除勞(lao)(lao)動(dong)合同(tong),不提前一(yi)(yi)個月(yue)(yue)的,應(ying)該給(gei)(gei)予(yu)一(yi)(yi)個月(yue)(yue)的工(gong)資作為通知替代金。同(tong)時(shi),公(gong)司應(ying)根(gen)據已履行的時(shi)間,給(gei)(gei)予(yu)經濟(ji)補償金。
