答 沒有(you)(you)(you)簽(qian)訂勞(lao)動(dong)(dong)合(he)同(tong)(tong),口(kou)頭約定(ding)(ding)的(de)(de)試(shi)用期(qi)(qi)(qi)是無效的(de)(de)。《勞(lao)動(dong)(dong)合(he)同(tong)(tong)法》第(di)十(shi)九(jiu)條(tiao)第(di)四款(kuan)規(gui)定(ding)(ding):“試(shi)用期(qi)(qi)(qi)包含在勞(lao)動(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)限(xian)內(nei)。”同(tong)(tong)時第(di)十(shi)條(tiao)又規(gui)定(ding)(ding):“建立(li)勞(lao)動(dong)(dong)關系,應當(dang)訂立(li)書(shu)面(mian)(mian)勞(lao)動(dong)(dong)合(he)同(tong)(tong)。”這些條(tiao)款(kuan)說明有(you)(you)(you)了(le)書(shu)面(mian)(mian)的(de)(de)勞(lao)動(dong)(dong)合(he)同(tong)(tong),才能有(you)(you)(you)試(shi)用期(qi)(qi)(qi)。因此,你這半年的(de)(de)工作,實(shi)際上已經(jing)處(chu)于建立(li)了(le)勞(lao)動(dong)(dong)關系,而(er)沒有(you)(you)(you)簽(qian)訂書(shu)面(mian)(mian)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的(de)(de)狀態。這一點不會因為單位(wei)跟(gen)你口(kou)頭說是見習或(huo)試(shi)用而(er)有(you)(you)(you)所改變。
