答 《勞(lao)動(dong)(dong)合同(tong)法(fa)》第八十(shi)二(er)條的處罰:“用人單(dan)位自用工(gong)(gong)(gong)之日起(qi)超(chao)過一(yi)(yi)個(ge)月(yue)不(bu)(bu)滿一(yi)(yi)年未與勞(lao)動(dong)(dong)者訂(ding)立書面(mian)勞(lao)動(dong)(dong)合同(tong)的,應(ying)當(dang)向(xiang)勞(lao)動(dong)(dong)者每(mei)月(yue)支(zhi)付二(er)倍的工(gong)(gong)(gong)資。”所(suo)以,開始工(gong)(gong)(gong)作一(yi)(yi)個(ge)月(yue)內不(bu)(bu)簽訂(ding)勞(lao)動(dong)(dong)合同(tong),是(shi)法(fa)律允許的。但是(shi)超(chao)過一(yi)(yi)個(ge)月(yue)還不(bu)(bu)簽訂(ding),就(jiu)要給(gei)予兩倍工(gong)(gong)(gong)資。兩倍工(gong)(gong)(gong)資從工(gong)(gong)(gong)作第二(er)個(ge)月(yue)開始給(gei)。
