試用期期間口頭辭職算數么?

答 勞(lao)(lao)動(dong)(dong)合(he)同(tong)試用(yong)(yong)(yong)期的特點在于雙方可以(yi)(yi)相對(dui)自(zi)由地解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)。《勞(lao)(lao)動(dong)(dong)合(he)同(tong)法(fa)》第三(san)(san)十七(qi)條規定:“勞(lao)(lao)動(dong)(dong)者在試用(yong)(yong)(yong)期內提前(qian)三(san)(san)日通知用(yong)(yong)(yong)人單(dan)位,可以(yi)(yi)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)。”這里(li)法(fa)律僅(jin)僅(jin)對(dui)員工提出了一個時間的要(yao)求(qiu)——三(san)(san)天。試用(yong)(yong)(yong)期內只要(yao)提前(qian)三(san)(san)天通知了用(yong)(yong)(yong)人單(dan)位,無論是書(shu)面的還是口頭的,員工就可以(yi)(yi)解除(chu)雙方的勞(lao)(lao)動(dong)(dong)合(he)同(tong)。
