臨時工還需要簽訂勞動合同?

答 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法》第十條“建(jian)立(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)關(guan)系,應(ying)當訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)。已建(jian)立(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)關(guan)系,未同(tong)(tong)(tong)時訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的,應(ying)當自用工(gong)之(zhi)日起一個月內訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)。用人單(dan)位與勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者在用工(gong)前訂立(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)關(guan)系自用工(gong)之(zhi)日起建(jian)立(li)。”《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法》第六十九條 “非全日制用工(gong)雙方當事人可(ke)以訂立(li)口頭協(xie)議(yi)。”所以,公司需(xu)要與你簽訂勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)。
