臨時工還需要簽訂勞動合同?

我是以臨(lin)時(shi)工的(de)身份進入公司的(de),現在想(xiang)咨詢(xun)一(yi)下,請問臨(lin)時(shi)工就(jiu)不需要簽訂(ding)勞動(dong)合同嗎?

《勞(lao)(lao)動(dong)合(he)(he)同(tong)法(fa)》第十條(tiao)“建立(li)(li)勞(lao)(lao)動(dong)關系,應(ying)當(dang)訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)合(he)(he)同(tong)。已建立(li)(li)勞(lao)(lao)動(dong)關系,未同(tong)時訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)合(he)(he)同(tong)的,應(ying)當(dang)自用(yong)工(gong)之日起(qi)一個(ge)月內訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)合(he)(he)同(tong)。用(yong)人(ren)單位與勞(lao)(lao)動(dong)者(zhe)在用(yong)工(gong)前訂(ding)立(li)(li)勞(lao)(lao)動(dong)合(he)(he)同(tong)的,勞(lao)(lao)動(dong)關系自用(yong)工(gong)之日起(qi)建立(li)(li)。”《勞(lao)(lao)動(dong)合(he)(he)同(tong)法(fa)》第六(liu)十九條(tiao) “非(fei)全日制用(yong)工(gong)雙(shuang)方當(dang)事人(ren)可以(yi)訂(ding)立(li)(li)口頭協議(yi)。”所以(yi),公司需要(yao)與你簽(qian)訂(ding)勞(lao)(lao)動(dong)合(he)(he)同(tong)。
