試用期內如被公司調崗的還要重新設置試用期嗎?

想咨詢一下大(da)家,試(shi)用期(qi)內如被公司調(diao)崗(gang)的(de)還要重新設置試(shi)用期(qi)嗎?

根據《勞動(dong)合同法》第十九條(tiao)規定:“同一用(yong)(yong)(yong)(yong)(yong)人單位與(yu)(yu)同一勞動(dong)者只(zhi)能約定一次試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)。” 試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)是與(yu)(yu)公司在(zai)勞動(dong)合同上協商確(que)定的,如果試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)已(yi)經(jing)(jing)過了,調(diao)換工作崗(gang)位,不(bu)能重(zhong)新設立試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)。如果在(zai)試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)內調(diao)整了工作崗(gang)位,之(zhi)前已(yi)經(jing)(jing)消耗的試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)用(yong)(yong)(yong)(yong)(yong)重(zhong)新再來一遍(bian),只(zhi)要繼續履行剩余試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)即(ji)可。如果因為調(diao)換了部門,雙方協商一致(zhi),依(yi)法變更試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)長短的話,之(zhi)前已(yi)經(jing)(jing)履行的部分(fen)試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)也不(bu)用(yong)(yong)(yong)(yong)(yong)重(zhong)新計(ji)算,而是按(an)新的試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)長短履行剩余的試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)。
