試用期內如被公司調崗的還要重新設置試用期嗎?

答 根據(ju)《勞動(dong)合(he)同(tong)法》第十九(jiu)條規定:“同(tong)一(yi)用(yong)(yong)(yong)人單(dan)位(wei)(wei)與(yu)(yu)同(tong)一(yi)勞動(dong)者只(zhi)能約(yue)定一(yi)次試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)。” 試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)是與(yu)(yu)公司在(zai)(zai)勞動(dong)合(he)同(tong)上協商確定的(de),如果試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)已經(jing)過(guo)了(le)(le),調換(huan)工作崗位(wei)(wei),不能重(zhong)新(xin)設立(li)試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)。如果在(zai)(zai)試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)內調整了(le)(le)工作崗位(wei)(wei),之前已經(jing)消耗的(de)試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不用(yong)(yong)(yong)重(zhong)新(xin)再來一(yi)遍,只(zhi)要繼續履行(xing)剩(sheng)余試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)即可。如果因為(wei)調換(huan)了(le)(le)部門,雙方協商一(yi)致,依法變更試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)長短(duan)的(de)話,之前已經(jing)履行(xing)的(de)部分試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)也不用(yong)(yong)(yong)重(zhong)新(xin)計(ji)算,而是按(an)新(xin)的(de)試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)長短(duan)履行(xing)剩(sheng)余的(de)試(shi)(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)。
