部門解散,勞動合同理當解除嗎?
問 最近(jin)我(wo)們(men)公(gong)司因(yin)為(wei)內(nei)部(bu)(bu)調整,把我(wo)們(men)部(bu)(bu)門(men)撤銷了,部(bu)(bu)門(men)解散(san),勞動合同(tong)理當(dang)解除嗎?
答 用(yong)人(ren)單(dan)位和勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)建(jian)立勞(lao)(lao)動(dong)(dong)關(guan)系的,應按照有關(guan)規定簽訂勞(lao)(lao)動(dong)(dong)合同。勞(lao)(lao)動(dong)(dong)合同的主體是(shi)(shi)用(yong)人(ren)單(dan)位和勞(lao)(lao)動(dong)(dong)者(zhe)(zhe),用(yong)人(ren)單(dan)位的某個部(bu)門(men)是(shi)(shi)不(bu)(bu)具有勞(lao)(lao)動(dong)(dong)法主體資(zi)格的。勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)和用(yong)人(ren)單(dan)位簽訂的勞(lao)(lao)動(dong)(dong)合同不(bu)(bu)因為用(yong)人(ren)單(dan)位內部(bu)某個部(bu)門(men)的解散而(er)失(shi)去效力,也就是(shi)(shi)說,雙(shuang)方勞(lao)(lao)動(dong)(dong)合同應繼續(xu)履行。
