企業能否單方面變更員工的工作崗位?

問(wen) 我是個職(zhi)場新(xin)人,現在想(xiang)咨詢一(yi)下,請問企業能(neng)否(fou)單方面變更員工的(de)工作崗位?

變(bian)(bian)(bian)更(geng)工作崗位(wei)屬于對勞(lao)動(dong)(dong)(dong)合(he)同(tong)的(de)變(bian)(bian)(bian)更(geng),但(dan)根據《勞(lao)動(dong)(dong)(dong)法(fa)》有(you)關規(gui)定(ding):勞(lao)動(dong)(dong)(dong)合(he)同(tong)訂立時所依據的(de)客觀情(qing)況發生重大變(bian)(bian)(bian)化,致使(shi)原勞(lao)動(dong)(dong)(dong)合(he)同(tong)無法(fa)履(lv)行,用人(ren)(ren)單位(wei)仍(reng)然必須履(lv)行與勞(lao)動(dong)(dong)(dong)者協(xie)商變(bian)(bian)(bian)更(geng)勞(lao)動(dong)(dong)(dong)合(he)同(tong)的(de)法(fa)定(ding)程(cheng)序,經當事人(ren)(ren)協(xie)商不(bu)能就變(bian)(bian)(bian)更(geng)勞(lao)動(dong)(dong)(dong)合(he)同(tong)達(da)成協(xie)議的(de)用人(ren)(ren)單位(wei)可以解除勞(lao)動(dong)(dong)(dong)合(he)同(tong),但(dan)是應當提前30日(ri)以書面的(de)形(xing)式通知(zhi)勞(lao)動(dong)(dong)(dong)者本人(ren)(ren)。
