企業能否單方面變更員工的工作崗位?

答 變更工作崗位屬于(yu)對勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的變更,但根據(ju)《勞(lao)(lao)動(dong)(dong)(dong)(dong)法》有關規定(ding):勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)訂立時所依據(ju)的客觀情況發(fa)生重大(da)變化,致使原勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)無(wu)法履行(xing),用人單位仍然必須履行(xing)與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)者協商變更勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的法定(ding)程序,經當事人協商不能(neng)就變更勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)達(da)成協議(yi)的用人單位可以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),但是應當提(ti)前30日以(yi)書面的形式通知勞(lao)(lao)動(dong)(dong)(dong)(dong)者本人。
