答 新的(de)(de)勞(lao)動(dong)(dong)合同(tong)(tong)法規定(ding):“建立勞(lao)動(dong)(dong)關(guan)系(xi),應(ying)當(dang)訂立書(shu)面勞(lao)動(dong)(dong)合同(tong)(tong)。”“已建立勞(lao)動(dong)(dong)關(guan)系(xi),未(wei)同(tong)(tong)時(shi)訂立書(shu)面勞(lao)動(dong)(dong)合同(tong)(tong)的(de)(de),應(ying)當(dang)自用(yong)工之日起一個月內訂立書(shu)面勞(lao)動(dong)(dong)合同(tong)(tong)。”試(shi)用(yong)期在勞(lao)動(dong)(dong)合同(tong)(tong)期限內,所(suo)以畢業(ye)入(ru)職(zhi)時(shi)應(ying)當(dang)與用(yong)人單位簽訂勞(lao)動(dong)(dong)合同(tong)(tong),同(tong)(tong)時(shi)就業(ye)協議書(shu)已完成(cheng)使命,自動(dong)(dong)失(shi)效(xiao)。
