試用期間一定要簽勞動合同嗎?

我是(shi)今年的畢(bi)業生(sheng),請問畢(bi)業后去用人(ren)單位上班試用期間(jian)一定(ding)要(yao)簽勞動合同(tong)嗎?

新的勞動(dong)(dong)合(he)(he)同法規定:“建(jian)立勞動(dong)(dong)關系,應(ying)(ying)當(dang)(dang)訂(ding)立書(shu)面勞動(dong)(dong)合(he)(he)同。”“已建(jian)立勞動(dong)(dong)關系,未(wei)同時訂(ding)立書(shu)面勞動(dong)(dong)合(he)(he)同的,應(ying)(ying)當(dang)(dang)自用(yong)工之日起一個月(yue)內訂(ding)立書(shu)面勞動(dong)(dong)合(he)(he)同。”試用(yong)期(qi)在勞動(dong)(dong)合(he)(he)同期(qi)限內,所以畢業(ye)入職時應(ying)(ying)當(dang)(dang)與用(yong)人單(dan)位簽訂(ding)勞動(dong)(dong)合(he)(he)同,同時就業(ye)協(xie)議書(shu)已完成使命,自動(dong)(dong)失效。
