單位解除勞動合同的合法事由有哪些?

答 一是協(xie)商解除 即(ji)《勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)法(fa)》第三(san)(san)十六條:“用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)協(xie)商一致,可(ke)以(yi)解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)。” 二(er)是過錯解除 即(ji)《勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)法(fa)》第三(san)(san)十九條:“勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)有下列(lie)情形之一的(de)(de),用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)可(ke)以(yi)解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong): (一)在(zai)試用(yong)(yong)(yong)(yong)(yong)期(qi)間(jian)被證明(ming)不符合(he)(he)錄用(yong)(yong)(yong)(yong)(yong)條件的(de)(de); (二(er))嚴重(zhong)違反用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)的(de)(de)規章制(zhi)度的(de)(de); (三(san)(san))嚴重(zhong)失職,營(ying)私舞弊(bi),給用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)造成重(zhong)大損害的(de)(de); (四(si))勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)同(tong)時與其他用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)建立勞(lao)(lao)(lao)(lao)動(dong)(dong)關系,對完(wan)成本單(dan)位(wei)(wei)(wei)的(de)(de)工作任務(wu)造成嚴重(zhong)影響,或(huo)者(zhe)(zhe)經用(yong)(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)(wei)提出,拒不改正的(de)(de); (五)因本法(fa)第二(er)十六條第一款第一項規定的(de)(de)情形致使(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)無效(xiao)的(de)(de);(六)被依法(fa)追究刑事(shi)責(ze)任的(de)(de)。”
