答 適(shi)(shi)用“雙倍(bei)工資”的范(fan)圍,我們說只(zhi)有符合(he)法律規定的,適(shi)(shi)用勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法調整的才可以“雙倍(bei)工資”。這(zhe)個適(shi)(shi)用范(fan)圍在《勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法》第2條“適(shi)(shi)用范(fan)圍”中有明確的規定,即“中華人(ren)民共和國(guo)境內的企業(ye)(ye)、個體經濟組(zu)織(zhi)、民辦非企業(ye)(ye)單位(wei)等(deng)組(zu)織(zhi)(以下稱用人(ren)單位(wei))與勞(lao)動(dong)(dong)(dong)(dong)者建立(li)勞(lao)動(dong)(dong)(dong)(dong)關系,訂(ding)立(li)、履(lv)行(xing)(xing)、變(bian)更、解(jie)除(chu)或者終止勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),適(shi)(shi)用本法。國(guo)家機關、事業(ye)(ye)單位(wei)、社會團體和與其建立(li)勞(lao)動(dong)(dong)(dong)(dong)關系的勞(lao)動(dong)(dong)(dong)(dong)者,訂(ding)立(li)、履(lv)行(xing)(xing)、變(bian)更、解(jie)除(chu)或者終止勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),依照(zhao)本法執行(xing)(xing)。”
