服務期超過勞動合同期限怎么辦?

問 勞(lao)動(dong)合同期(qi)限(xian)是(shi)勞(lao)動(dong)合同確定的(de),用人單位與勞(lao)動(dong)者享有、履行(xing)各(ge)自勞(lao)動(dong)權利(li)義務關系的(de)期(qi)限(xian),但是(shi)服(fu)務期(qi)超過勞(lao)動(dong)合同期(qi)限(xian)怎么辦?
答 根據《中(zhong)華人(ren)民共和國勞(lao)動(dong)(dong)合同法實(shi)施條(tiao)例》第17條(tiao)的(de)規定(ding)(ding)(ding):“勞(lao)動(dong)(dong)合同期(qi)滿,但(dan)是用人(ren)單位與勞(lao)動(dong)(dong)者約定(ding)(ding)(ding)的(de)服務(wu)(wu)期(qi)尚未到期(qi)的(de),勞(lao)動(dong)(dong)合同應當續延至(zhi)服務(wu)(wu)期(qi)滿;雙方(fang)另有約定(ding)(ding)(ding)的(de),從其約定(ding)(ding)(ding)。”因(yin)此,除非(fei)當事人(ren)另有約定(ding)(ding)(ding),否(fou)則,勞(lao)動(dong)(dong)合同期(qi)限應順延至(zhi)服務(wu)(wu)期(qi)滿。
