服務期超過勞動合同期限怎么辦?

勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期限是勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)確定的(de)(de),用人單位與勞(lao)動(dong)(dong)(dong)(dong)者享有、履行(xing)各自(zi)勞(lao)動(dong)(dong)(dong)(dong)權利義(yi)務關(guan)系的(de)(de)期限,但是服(fu)務期超過(guo)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期限怎么辦?

根據《中華(hua)人民共和國(guo)勞(lao)(lao)(lao)動合同(tong)(tong)法實施條例》第17條的規(gui)定(ding)(ding):“勞(lao)(lao)(lao)動合同(tong)(tong)期(qi)滿(man)(man),但(dan)是(shi)用(yong)人單位與勞(lao)(lao)(lao)動者約(yue)(yue)定(ding)(ding)的服務期(qi)尚未(wei)到(dao)期(qi)的,勞(lao)(lao)(lao)動合同(tong)(tong)應當續延(yan)至服務期(qi)滿(man)(man);雙方另有約(yue)(yue)定(ding)(ding)的,從其(qi)約(yue)(yue)定(ding)(ding)。”因此,除非當事人另有約(yue)(yue)定(ding)(ding),否則(ze),勞(lao)(lao)(lao)動合同(tong)(tong)期(qi)限(xian)應順延(yan)至服務期(qi)滿(man)(man)。
