訂立勞動合同的方法有哪些?

答 (一(yi)(yi))原(yuan)則《勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)法(fa)》第(di)三條規定:訂(ding)立(li)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong),應當遵循合(he)(he)(he)(he)法(fa)、公平、平等自(zi)愿(yuan)、協商(shang)一(yi)(yi)致、誠實(shi)信(xin)用(yong)的原(yuan)則。依法(fa)訂(ding)立(li)的勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)具有約(yue)束力,用(yong)人單位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)者應當履行勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)規定的義務。 (二)簽(qian)訂(ding)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)由用(yong)人單位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)者協商(shang)一(yi)(yi)致,并經用(yong)人單位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)者在(zai)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)文本上簽(qian)字(zi)或者蓋章生效。勞(lao)(lao)動(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)文本由用(yong)人單位(wei)和勞(lao)(lao)動(dong)(dong)者各執一(yi)(yi)份(fen)。
