(一(yi)(yi))原則《勞(lao)動(dong)(dong)合(he)同(tong)(tong)法》第三(san)條規定:訂(ding)立勞(lao)動(dong)(dong)合(he)同(tong)(tong),應當遵循合(he)法、公平(ping)、平(ping)等自愿、協商(shang)一(yi)(yi)致(zhi)、誠實信(xin)用的原則。依法訂(ding)立的勞(lao)動(dong)(dong)合(he)同(tong)(tong)具有約束(shu)力,用人單(dan)(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)應當履行勞(lao)動(dong)(dong)合(he)同(tong)(tong)規定的義(yi)務。 (二)簽(qian)訂(ding)勞(lao)動(dong)(dong)合(he)同(tong)(tong)由(you)用人單(dan)(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)協商(shang)一(yi)(yi)致(zhi),并經用人單(dan)(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)在勞(lao)動(dong)(dong)合(he)同(tong)(tong)文(wen)本(ben)上簽(qian)字或者(zhe)(zhe)蓋章生效。勞(lao)動(dong)(dong)合(he)同(tong)(tong)文(wen)本(ben)由(you)用人單(dan)(dan)位(wei)和勞(lao)動(dong)(dong)者(zhe)(zhe)各(ge)執一(yi)(yi)份(fen)。
