沒有簽訂勞動合同有試用期嗎?

實踐中有(you)的用(yong)人單(dan)位為逃避對(dui)員(yuan)工(gong)(gong)的義務,在建立了用(yong)工(gong)(gong)關系(xi)之后(hou),也沒有(you)按照規定與(yu)員(yuan)工(gong)(gong)實際(ji)簽訂書面的勞(lao)動合(he)同(tong),沒有(you)簽訂勞(lao)動合(he)同(tong)有(you)試用(yong)期嗎?

《勞(lao)(lao)動部關(guan)(guan)于(yu)實行勞(lao)(lao)動合(he)同制度若(ruo)(ruo)干(gan)問題的通知》中(zhong)明確說(shuo):“試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)包括在勞(lao)(lao)動合(he)同期(qi)(qi)(qi)限(xian)(xian)中(zhong)。”《勞(lao)(lao)動部關(guan)(guan)于(yu)印發〈關(guan)(guan)于(yu)貫徹執(zhi)行《中(zhong)華(hua)人民共和國勞(lao)(lao)動法(fa)》若(ruo)(ruo)干(gan)問題的意見〉的通知》中(zhong)也表示:“勞(lao)(lao)動者被用(yong)(yong)人單位錄用(yong)(yong)后(hou),雙方可以在勞(lao)(lao)動合(he)同中(zhong)的約定試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi),試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)應(ying)包括在勞(lao)(lao)動合(he)同期(qi)(qi)(qi)限(xian)(xian)內。”所有其他的關(guan)(guan)于(yu)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的法(fa)律(lv)條(tiao)文也是就試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)在勞(lao)(lao)動合(he)同期(qi)(qi)(qi)限(xian)(xian)中(zhong)的情況來(lai)規定的。比如“勞(lao)(lao)動合(he)同期(qi)(qi)(qi)限(xian)(xian)在六個月以下的,試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不得超過十(shi)五日”等(deng)等(deng)。可以說(shuo)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)是兒子(zi),勞(lao)(lao)動合(he)同是母親,沒(mei)有母親哪里來(lai)的兒子(zi)呢(ni)!在事實已經(jing)發生的情況下,很顯(xian)然,沒(mei)有勞(lao)(lao)動合(he)同,試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的說(shuo)法(fa)就不能(neng)成立(li)。
