沒有簽訂勞動合同有試用期嗎?

答 《勞(lao)(lao)(lao)(lao)動(dong)(dong)部關(guan)于實(shi)(shi)行勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)制度(du)若(ruo)(ruo)干問題(ti)的(de)(de)通知》中(zhong)明確(que)說(shuo):“試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)包括在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)期(qi)(qi)限(xian)(xian)(xian)中(zhong)。”《勞(lao)(lao)(lao)(lao)動(dong)(dong)部關(guan)于印發(fa)〈關(guan)于貫(guan)徹(che)執行《中(zhong)華(hua)人民(min)共(gong)和國勞(lao)(lao)(lao)(lao)動(dong)(dong)法》若(ruo)(ruo)干問題(ti)的(de)(de)意見〉的(de)(de)通知》中(zhong)也表示:“勞(lao)(lao)(lao)(lao)動(dong)(dong)者被(bei)用(yong)(yong)(yong)(yong)(yong)人單位錄用(yong)(yong)(yong)(yong)(yong)后,雙方可(ke)以在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)的(de)(de)約(yue)定試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi),試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)應包括在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)期(qi)(qi)限(xian)(xian)(xian)內(nei)。”所有其他的(de)(de)關(guan)于試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)法律條文也是就試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)期(qi)(qi)限(xian)(xian)(xian)中(zhong)的(de)(de)情(qing)況來規(gui)定的(de)(de)。比如“勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)期(qi)(qi)限(xian)(xian)(xian)在(zai)(zai)六(liu)個月以下的(de)(de),試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)不得(de)超(chao)過十五日”等等。可(ke)以說(shuo)試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)是兒子,勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)是母親,沒有母親哪里來的(de)(de)兒子呢!在(zai)(zai)事(shi)實(shi)(shi)已經(jing)發(fa)生的(de)(de)情(qing)況下,很(hen)顯然,沒有勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong),試(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)說(shuo)法就不能成立。
