女職(zhi)(zhi)工(gong)在(zai)哺乳(ru)期間,用人(ren)單(dan)位解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)的(de),用人(ren)單(dan)位必須支(zhi)(zhi)付(fu)(fu)(fu)給勞(lao)(lao)動(dong)(dong)(dong)者經(jing)濟(ji)補(bu)(bu)(bu)(bu)償(chang)(chang)金。經(jing)濟(ji)補(bu)(bu)(bu)(bu)償(chang)(chang)按(an)勞(lao)(lao)動(dong)(dong)(dong)者在(zai)本(ben)單(dan)位工(gong)作的(de)年(nian)(nian)(nian)限,每滿一年(nian)(nian)(nian)支(zhi)(zhi)付(fu)(fu)(fu)一個(ge)月工(gong)資(zi)的(de)標(biao)準(zhun)向勞(lao)(lao)動(dong)(dong)(dong)者支(zhi)(zhi)付(fu)(fu)(fu)。六(liu)(liu)個(ge)月以上不滿一年(nian)(nian)(nian)的(de),按(an)一年(nian)(nian)(nian)計算;不滿六(liu)(liu)個(ge)月的(de),向勞(lao)(lao)動(dong)(dong)(dong)者支(zhi)(zhi)付(fu)(fu)(fu)半(ban)個(ge)月工(gong)資(zi)的(de)經(jing)濟(ji)補(bu)(bu)(bu)(bu)償(chang)(chang)。勞(lao)(lao)動(dong)(dong)(dong)者月工(gong)資(zi)高于用人(ren)單(dan)位所在(zai)直轄市、設區的(de)市級人(ren)民政府公布的(de)本(ben)地區上年(nian)(nian)(nian)度職(zhi)(zhi)工(gong)月平均(jun)工(gong)資(zi)三倍的(de),向其支(zhi)(zhi)付(fu)(fu)(fu)經(jing)濟(ji)補(bu)(bu)(bu)(bu)償(chang)(chang)的(de)標(biao)準(zhun)按(an)職(zhi)(zhi)工(gong)月平均(jun)工(gong)資(zi)三倍的(de)數(shu)額支(zhi)(zhi)付(fu)(fu)(fu),向其支(zhi)(zhi)付(fu)(fu)(fu)經(jing)濟(ji)補(bu)(bu)(bu)(bu)償(chang)(chang)的(de)年(nian)(nian)(nian)限最高不超過十(shi)(shi)二年(nian)(nian)(nian)。所稱月工(gong)資(zi)是(shi)指勞(lao)(lao)動(dong)(dong)(dong)者在(zai)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)解(jie)除或者終止前十(shi)(shi)二個(ge)月的(de)平均(jun)工(gong)資(zi)。
