勞動合同無效怎么處理?

答 《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)(fa)(fa)》第(di)三十(shi)九條(tiao)規(gui)定(ding)(ding):“勞(lao)(lao)動(dong)(dong)(dong)者(zhe)有下(xia)列情形(xing)之一的(de)(de),用(yong)人(ren)單(dan)位可(ke)以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong):……(五)因本法(fa)(fa)(fa)第(di)二(er)十(shi)六條(tiao)第(di)一款(kuan)第(di)一項(xiang)規(gui)定(ding)(ding)的(de)(de)情形(xing)致(zhi)使勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)無效(xiao)的(de)(de);……。”用(yong)人(ren)單(dan)位認為勞(lao)(lao)動(dong)(dong)(dong)者(zhe)確實(shi)以(yi)欺詐手段使單(dan)位違背真實(shi)意(yi)思簽訂了勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de),可(ke)以(yi)立即(ji)解除(chu)雙方的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)。結合(he)(he)《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)(fa)(fa)》第(di)四十(shi)六條(tiao)有關經濟補償金(jin)的(de)(de)規(gui)定(ding)(ding)可(ke)以(yi)發現,因為勞(lao)(lao)動(dong)(dong)(dong)者(zhe)原因致(zhi)使勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)無效(xiao)而解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de),單(dan)位不(bu)需要支付任何經濟補償金(jin)。
