轉崗后,用人單位想延長試用期,可以不可以呢?

我已(yi)經通過試用(yong)期了,但是公司讓(rang)我轉崗,轉崗后,用(yong)人單(dan)位想延長試用(yong)期,可(ke)(ke)以(yi)不可(ke)(ke)以(yi)呢?

由于(yu)試用(yong)(yong)(yong)期是(shi)勞(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)(tong)(tong)上所(suo)約(yue)定(ding)(ding)的一(yi)段期間,它的延長規(gui)(gui)則,適用(yong)(yong)(yong)勞(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)(tong)(tong)的一(yi)般規(gui)(gui)則。根(gen)據(ju)《勞(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)(tong)(tong)法(fa)》第三十五條(tiao)規(gui)(gui)定(ding)(ding):“用(yong)(yong)(yong)人(ren)單位與勞(lao)(lao)(lao)動者協商一(yi)致(zhi),可(ke)以變(bian)更勞(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)(tong)(tong)約(yue)定(ding)(ding)的內容。”因此(ci),用(yong)(yong)(yong)人(ren)單位如(ru)果希望變(bian)更試用(yong)(yong)(yong)期的長短,必(bi)須(xu)得到(dao)員工(gong)的書面同(tong)(tong)(tong)(tong)(tong)意。同(tong)(tong)(tong)(tong)(tong)時,由于(yu)試用(yong)(yong)(yong)期有最長限制,變(bian)更后的全部試用(yong)(yong)(yong)期不(bu)能超過法(fa)律的規(gui)(gui)定(ding)(ding)。
