試用期(qi)是指包括在勞(lao)動合同期(qi)限內,勞(lao)動關(guan)系還(huan)處于非正式狀態,關(guan)于試用期(qi)間離(li)職是如(ru)何規定的?

勞動(dong)合(he)(he)同(tong)(tong)法》規(gui)定:“勞動(dong)者(zhe)(zhe)提前30日(ri)以(yi)書面形(xing)式通(tong)知用(yong)人(ren)單位,可以(yi)解(jie)除(chu)勞動(dong)合(he)(he)同(tong)(tong)。勞動(dong)者(zhe)(zhe)在(zai)試用(yong)期內提前3日(ri)通(tong)知用(yong)人(ren)單位,可以(yi)解(jie)除(chu)勞動(dong)合(he)(he)同(tong)(tong)。”第二十條 勞動(dong)者(zhe)(zhe)在(zai)試用(yong)期的(de)工資(zi)不(bu)得(de)低于本單位相同(tong)(tong)崗位最低檔工資(zi)或者(zhe)(zhe)勞動(dong)合(he)(he)同(tong)(tong)約(yue)定工資(zi)的(de)百分(fen)之八(ba)十,并(bing)不(bu)得(de)低于用(yong)人(ren)單位所(suo)在(zai)地的(de)最低工資(zi)標準(zhun)。第二十一條 在(zai)試用(yong)期中(zhong),除(chu)勞動(dong)者(zhe)(zhe)有本法第三(san)十九(jiu)條和第四(si)十條第一項(xiang)、第二項(xiang)規(gui)定的(de)情形(xing)外(wai),用(yong)人(ren)單位不(bu)得(de)解(jie)除(chu)勞動(dong)合(he)(he)同(tong)(tong)。用(yong)人(ren)單位在(zai)試用(yong)期解(jie)除(chu)勞動(dong)合(he)(he)同(tong)(tong)的(de),應當向勞動(dong)者(zhe)(zhe)說明理由。
