答 勞(lao)動(dong)(dong)者在(zai)(zai)試用(yong)(yong)(yong)期(qi)被證明不(bu)符(fu)合(he)錄(lu)(lu)用(yong)(yong)(yong)條(tiao)件(jian)的,用(yong)(yong)(yong)人(ren)單位(wei)可(ke)以(yi)(yi)解(jie)除(chu)勞(lao)動(dong)(dong)合(he)同。但判斷勞(lao)動(dong)(dong)者在(zai)(zai)試用(yong)(yong)(yong)期(qi)內(nei)(nei)(nei)是(shi)否符(fu)合(he)錄(lu)(lu)用(yong)(yong)(yong)條(tiao)件(jian)必(bi)(bi)須具備以(yi)(yi)下三個條(tiao)件(jian):一是(shi)用(yong)(yong)(yong)人(ren)單位(wei)要有明確(que)(que)的錄(lu)(lu)用(yong)(yong)(yong)條(tiao)件(jian),且(qie)明確(que)(que)告知勞(lao)動(dong)(dong)者;二是(shi)用(yong)(yong)(yong)人(ren)單位(wei)對(dui)勞(lao)動(dong)(dong)者在(zai)(zai)試用(yong)(yong)(yong)期(qi)內(nei)(nei)(nei)的工作進(jin)行考核(he),以(yi)(yi)確(que)(que)認是(shi)否符(fu)合(he)其(qi)錄(lu)(lu)用(yong)(yong)(yong)條(tiao)件(jian);三是(shi)以(yi)(yi)“不(bu)符(fu)合(he)錄(lu)(lu)用(yong)(yong)(yong)條(tiao)件(jian)”為由(you)解(jie)除(chu)勞(lao)動(dong)(dong)合(he)同必(bi)(bi)須在(zai)(zai)試用(yong)(yong)(yong)期(qi)內(nei)(nei)(nei)進(jin)行,否則,即使勞(lao)動(dong)(dong)者在(zai)(zai)試用(yong)(yong)(yong)期(qi)內(nei)(nei)(nei)考核(he)不(bu)合(he)格,用(yong)(yong)(yong)人(ren)單位(wei)也不(bu)能以(yi)(yi)此為由(you)與勞(lao)動(dong)(dong)者解(jie)除(chu)勞(lao)動(dong)(dong)合(he)同。
