試用期的職工享受醫療期嗎?

答 醫(yi)(yi)療(liao)期(qi)是(shi)勞(lao)動合(he)(he)同履行中為勞(lao)動者(zhe)(zhe)規定的必要的治(zhi)療(liao)康(kang)復(fu)保障(zhang)期(qi)間(jian),因此,即使(shi)是(shi)處(chu)在(zai)(zai)試用期(qi)階段的企業職(zhi)(zhi)工(gong)(gong)(gong),也(ye)是(shi)有(you)權享有(you)醫(yi)(yi)療(liao)期(qi)及相(xiang)關待遇。企業不(bu)(bu)得(de)因為職(zhi)(zhi)工(gong)(gong)(gong)是(shi)在(zai)(zai)試用期(qi)中而剝奪職(zhi)(zhi)工(gong)(gong)(gong)應(ying)享有(you)的醫(yi)(yi)療(liao)期(qi)及相(xiang)應(ying)的待遇,不(bu)(bu)得(de)因職(zhi)(zhi)工(gong)(gong)(gong)要求(qiu)享有(you)醫(yi)(yi)療(liao)期(qi)及相(xiang)關待遇就與職(zhi)(zhi)工(gong)(gong)(gong)解除合(he)(he)同。當職(zhi)(zhi)工(gong)(gong)(gong)在(zai)(zai)享有(you)的醫(yi)(yi)療(liao)期(qi)醫(yi)(yi)療(liao)終結,不(bu)(bu)能從事原工(gong)(gong)(gong)作,也(ye)不(bu)(bu)能從事用人單(dan)位另行安排的工(gong)(gong)(gong)作的,用人單(dan)位應(ying)按照國(guo)家規定與職(zhi)(zhi)工(gong)(gong)(gong)解除勞(lao)動合(he)(he)同。為加強對(dui)醫(yi)(yi)療(liao)期(qi)內的患(huan)病(bing)職(zhi)(zhi)工(gong)(gong)(gong)的康(kang)復(fu)保障(zhang),《勞(lao)動法》第29條規定:勞(lao)動者(zhe)(zhe)患(huan)病(bing)或者(zhe)(zhe)非因工(gong)(gong)(gong)負傷(shang),不(bu)(bu)得(de)對(dui)其進行裁員。
