建立勞(lao)動(dong)(dong)(dong)關系,應(ying)(ying)當(dang)簽訂(ding)勞(lao)動(dong)(dong)(dong)合同(tong)。《勞(lao)動(dong)(dong)(dong)合同(tong)法》第(di)八十二條規(gui)(gui)定:用(yong)人單(dan)位(wei)自(zi)用(yong)工之(zhi)日起超過一個月(yue)(yue)不(bu)滿一年未(wei)與勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立書面勞(lao)動(dong)(dong)(dong)合同(tong)的(de)(de)(de)(de)(de),應(ying)(ying)當(dang)向(xiang)勞(lao)動(dong)(dong)(dong)者(zhe)每月(yue)(yue)支(zhi)付2倍(bei)工資(zi)。用(yong)人單(dan)位(wei)違(wei)反(fan)本法規(gui)(gui)定不(bu)與勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立無固定期(qi)限勞(lao)動(dong)(dong)(dong)合同(tong)的(de)(de)(de)(de)(de),自(zi)應(ying)(ying)當(dang)訂(ding)立無固定期(qi)限勞(lao)動(dong)(dong)(dong)合同(tong)之(zhi)日起向(xiang)勞(lao)動(dong)(dong)(dong)者(zhe)每月(yue)(yue)支(zhi)付二倍(bei)的(de)(de)(de)(de)(de)工資(zi)。《勞(lao)動(dong)(dong)(dong)合同(tong)法》第(di)85條規(gui)(gui)定,未(wei)按照(zhao)國家規(gui)(gui)定及時足(zu)額支(zhi)付勞(lao)動(dong)(dong)(dong)者(zhe)勞(lao)動(dong)(dong)(dong)報酬的(de)(de)(de)(de)(de),由勞(lao)動(dong)(dong)(dong)行政部(bu)門責(ze)令(ling)限期(qi)支(zhi)付勞(lao)動(dong)(dong)(dong)報酬,逾期(qi)不(bu)支(zhi)付的(de)(de)(de)(de)(de),責(ze)令(ling)用(yong)人單(dan)位(wei)按應(ying)(ying)付金額50%以上100%以下的(de)(de)(de)(de)(de)標準向(xiang)勞(lao)動(dong)(dong)(dong)者(zhe)加付賠(pei)償金。
