可以將試用期從勞動合同期限中剝離出來嗎?

答 《勞(lao)動(dong)合(he)同(tong)(tong)法》第19條第4款約定(ding),勞(lao)動(dong)合(he)同(tong)(tong)僅約定(ding)試用(yong)(yong)(yong)期(qi)或(huo)者勞(lao)動(dong)合(he)同(tong)(tong)期(qi)限(xian)(xian)與試用(yong)(yong)(yong)期(qi)相同(tong)(tong)的(de),試用(yong)(yong)(yong)期(qi)不成(cheng)立,該期(qi)限(xian)(xian)為(wei)勞(lao)動(dong)合(he)同(tong)(tong)期(qi)限(xian)(xian)。這就(jiu)意(yi)味著(zhu),單獨(du)的(de)試用(yong)(yong)(yong)期(qi)合(he)同(tong)(tong)被試作正式合(he)同(tong)(tong),勞(lao)動(dong)合(he)同(tong)(tong)如果(guo)只(zhi)約定(ding)試用(yong)(yong)(yong)期(qi)的(de),那(nei)么該試用(yong)(yong)(yong)期(qi)就(jiu)是(shi)合(he)同(tong)(tong)的(de)期(qi)限(xian)(xian),視為(wei)用(yong)(yong)(yong)人單位放棄對您進(jin)行試用(yong)(yong)(yong)的(de)權(quan)利。
