不簽勞動合同必賠兩倍工資嗎?

《勞動(dong)合同(tong)法》規定(ding)對勞動(dong)合同(tong)的簽訂要求非常嚴格(ge),新法實施后,勞動(dong)者起訴索要雙倍工資的案件大(da)幅度增(zeng)加,那(nei)么(me)是(shi)不是(shi)不簽訂勞動(dong)合同(tong)就一定(ding)能(neng)拿到(dao)雙倍工資呢?

法(fa)(fa)(fa)律明確(que)規(gui)定(ding)的(de)(de)(de)是用(yong)人(ren)單位(wei)(wei)不(bu)依法(fa)(fa)(fa)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者簽(qian)訂(ding)書面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,才須承擔支付每月兩(liang)倍(bei)工(gong)資的(de)(de)(de)法(fa)(fa)(fa)律責任,如果(guo)是由于(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者故(gu)意(yi)或(huo)不(bu)愿意(yi)與(yu)用(yong)人(ren)單位(wei)(wei)簽(qian)訂(ding)書面(mian)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同的(de)(de)(de),則不(bu)適用(yong)于(yu)該條款。因為新的(de)(de)(de)《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同法(fa)(fa)(fa)》立法(fa)(fa)(fa)的(de)(de)(de)本意(yi)就是要規(gui)范(fan)用(yong)人(ren)單位(wei)(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者簽(qian)訂(ding)書面(mian)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,保障勞(lao)(lao)(lao)動(dong)(dong)(dong)者的(de)(de)(de)合(he)法(fa)(fa)(fa)權益(yi),并非(fei)給予勞(lao)(lao)(lao)動(dong)(dong)(dong)者不(bu)簽(qian)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同便可得到(dao)雙倍(bei)工(gong)資的(de)(de)(de)權利。因此,如果(guo)員(yuan)工(gong)故(gu)意(yi)或(huo)不(bu)愿意(yi)簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,則無權獲得兩(liang)倍(bei)工(gong)資,而企業在這種情況下可以解除勞(lao)(lao)(lao)動(dong)(dong)(dong)關系并且(qie)不(bu)用(yong)支付經(jing)濟補償(chang)金。
