試用期合同能否單獨簽定?
問 我(wo)是(shi)個職場新人,現在(zai)在(zai)試用期(qi)期(qi)間,想咨詢(xun)一下,試用期(qi)合同能(neng)否單獨簽定?
答 相關法(fa)規(gui):《勞(lao)動(dong)(dong)合(he)同(tong)法(fa)》第19條第4款(kuan)規(gui)定(ding):“試用(yong)(yong)期(qi)(qi)(qi)包含在勞(lao)動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)限(xian)內。勞(lao)動(dong)(dong)合(he)同(tong)僅約定(ding)試用(yong)(yong)期(qi)(qi)(qi)的,試用(yong)(yong)期(qi)(qi)(qi)不成立,該期(qi)(qi)(qi)限(xian)為勞(lao)動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)限(xian)。”第46條第5項的規(gui)定(ding):除用(yong)(yong)人單位維(wei)持或者提高勞(lao)動(dong)(dong)合(he)同(tong)約定(ding)條件(jian)續(xu)訂勞(lao)動(dong)(dong)合(he)同(tong),勞(lao)動(dong)(dong)者不同(tong)意(yi)續(xu)訂的情形外,依照本法(fa)第44條第1項規(gui)定(ding)終止固定(ding)期(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)合(he)同(tong)的,應支付經濟補償。
