勞(lao)(lao)動(dong)者(zhe)在試(shi)用(yong)期(qi)間(jian)被證(zheng)(zheng)明不符合(he)錄用(yong)條(tiao)件(jian)的,用(yong)人(ren)單位可以解(jie)(jie)除勞(lao)(lao)動(dong)合(he)同。條(tiao)件(jian)是(shi),必須舉證(zheng)(zheng)證(zheng)(zheng)明勞(lao)(lao)動(dong)者(zhe)在試(shi)用(yong)期(qi)間(jian)不符合(he)錄用(yong)條(tiao)件(jian)。按(an)照《勞(lao)(lao)動(dong)合(he)同法(fa)》規定(ding),試(shi)用(yong)期(qi)內(nei),單位因勞(lao)(lao)動(dong)者(zhe)存(cun)在過失性(xing)行為與其解(jie)(jie)除勞(lao)(lao)動(dong)合(he)同的,無(wu)需(xu)支(zhi)付經(jing)濟補償金(jin)。
