問 對負有保密義務的勞動(dong)者(zhe),用人單位可(ke)以在勞動(dong)合(he)同(tong)或者(zhe)保密協議中與勞動(dong)者(zhe)約定競(jing)業限制條款?
答 《勞(lao)動(dong)(dong)合(he)同(tong)法(fa)》第二十三條(tiao)第二款規定(ding)(ding):“對(dui)負有保密義務的勞(lao)動(dong)(dong)者(zhe)(zhe),用人單位可以在勞(lao)動(dong)(dong)合(he)同(tong)或(huo)者(zhe)(zhe)保密協議中(zhong)與勞(lao)動(dong)(dong)者(zhe)(zhe)約(yue)定(ding)(ding)競(jing)業限制條(tiao)款,并約(yue)定(ding)(ding)在解除或(huo)者(zhe)(zhe)終止勞(lao)動(dong)(dong)合(he)同(tong)后(hou),在競(jing)業限制期限內按月(yue)給予勞(lao)動(dong)(dong)者(zhe)(zhe)經濟(ji)補償。勞(lao)動(dong)(dong)者(zhe)(zhe)違(wei)反競(jing)業限制約(yue)定(ding)(ding)的,應(ying)當按照約(yue)定(ding)(ding)向(xiang)用人單位支付違(wei)約(yue)金。”
