答 勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同法第七(qi)條(tiao)規定,用(yong)(yong)(yong)人(ren)單(dan)位(wei)自(zi)(zi)用(yong)(yong)(yong)工之(zhi)(zhi)日起即與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者建立(li)(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)。第十(shi)條(tiao)規定,建立(li)(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi),應當訂(ding)(ding)立(li)(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同。已建立(li)(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi),未(wei)同時訂(ding)(ding)立(li)(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同的,應當自(zi)(zi)用(yong)(yong)(yong)工之(zhi)(zhi)日起一個(ge)月內訂(ding)(ding)立(li)(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同。用(yong)(yong)(yong)人(ren)單(dan)位(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者在用(yong)(yong)(yong)工前訂(ding)(ding)立(li)(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同的,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)自(zi)(zi)用(yong)(yong)(yong)工之(zhi)(zhi)日起建立(li)(li)(li)(li)。所(suo)以(yi)畢業入職時應當與用(yong)(yong)(yong)人(ren)單(dan)位(wei)簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,同時就業協議書(shu)已完成使命,自(zi)(zi)動(dong)(dong)(dong)失效(xiao)。
