答 除(chu)勞(lao)(lao)動(dong)(dong)者與(yu)用(yong)人單(dan)位協(xie)商一(yi)(yi)致的情形外,勞(lao)(lao)動(dong)(dong)者依照勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法第(di)十四條(tiao)第(di)二(er)款的規定,提出訂(ding)立(li)無(wu)固定期限勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的,用(yong)人單(dan)位應當(dang)與(yu)其訂(ding)立(li)無(wu)固定期限勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。對勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的內(nei)(nei)容,雙方應當(dang)按(an)照合(he)法、公平、平等(deng)自愿、協(xie)商一(yi)(yi)致、誠實信用(yong)的原則協(xie)商確定;對協(xie)商不一(yi)(yi)致的內(nei)(nei)容,依照勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法第(di)十八條(tiao)的規定執行(xing)。
