一(yi)個月之前找(zhao)了一(yi)份(fen)工作,還在試用(yong)期,薪水太少了,我正在尋找(zhao)工資更高的崗位(wei),哪些情況(kuang)勞動(dong)者可以(yi)隨(sui)時通知用(yong)人(ren)單位(wei)解(jie)除(chu)勞動(dong)合同?

(1)在(zai)(zai)試用(yong)(yong)(yong)(yong)期(qi)內。試用(yong)(yong)(yong)(yong)期(qi)不(bu)(bu)但(dan)是(shi)(shi)(shi)用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)對(dui)新招收(shou)職工(gong)(gong)各方(fang)面的(de)(de)(de)(de)(de)(de)情(qing)況(kuang)進行(xing)進一步考察(cha)的(de)(de)(de)(de)(de)(de)期(qi)限,也是(shi)(shi)(shi)新招收(shou)職工(gong)(gong)用(yong)(yong)(yong)(yong)以(yi)考察(cha)用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)的(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)條件(jian)、勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬是(shi)(shi)(shi)否符合(he)(he)(he)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)規定(ding)的(de)(de)(de)(de)(de)(de)期(qi)限。在(zai)(zai)試用(yong)(yong)(yong)(yong)期(qi)內,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)發現用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)的(de)(de)(de)(de)(de)(de)實(shi)際(ji)情(qing)況(kuang)與訂立勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)時(shi)所介紹的(de)(de)(de)(de)(de)(de)情(qing)況(kuang)不(bu)(bu)相(xiang)(xiang)符合(he)(he)(he)時(shi),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)可(ke)(ke)以(yi)隨時(shi)要求解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)。如(ru)果勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)由(you)(you)(you)(you)于個(ge)人(ren)(ren)(ren)(ren)原因,不(bu)(bu)能或(huo)不(bu)(bu)愿意再(zai)在(zai)(zai)該用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)工(gong)(gong)作,只要在(zai)(zai)試用(yong)(yong)(yong)(yong)期(qi)內,也可(ke)(ke)以(yi)隨時(shi)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)。 (2)用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)以(yi)暴(bao)力(li)(li)、威脅或(huo)者(zhe)(zhe)非(fei)法(fa)(fa)限制人(ren)(ren)(ren)(ren)身(shen)自(zi)由(you)(you)(you)(you)的(de)(de)(de)(de)(de)(de)手(shou)段強(qiang)迫勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)的(de)(de)(de)(de)(de)(de)。“暴(bao)力(li)(li)”是(shi)(shi)(shi)指對(dui)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)實(shi)施捆綁、拉拽、毆打、傷害等行(xing)為。“威脅”是(shi)(shi)(shi)指對(dui)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)施以(yi)暴(bao)力(li)(li)或(huo)者(zhe)(zhe)其(qi)他(ta)(ta)強(qiang)迫手(shou)段。人(ren)(ren)(ren)(ren)身(shen)自(zi)由(you)(you)(you)(you)主(zhu)要指公民(min)(min)的(de)(de)(de)(de)(de)(de)人(ren)(ren)(ren)(ren)身(shen)不(bu)(bu)受侵(qin)犯以(yi)及與此相(xiang)(xiang)關(guan)(guan)的(de)(de)(de)(de)(de)(de)住(zhu)宅和(he)人(ren)(ren)(ren)(ren)格尊嚴不(bu)(bu)受侵(qin)犯等,它是(shi)(shi)(shi)公民(min)(min)各種自(zi)由(you)(you)(you)(you)權(quan)(quan)利當中的(de)(de)(de)(de)(de)(de)一種基本自(zi)由(you)(you)(you)(you),是(shi)(shi)(shi)公民(min)(min)參(can)加社會活(huo)動(dong)(dong)(dong)(dong)(dong)和(he)享受其(qi)他(ta)(ta)權(quan)(quan)利的(de)(de)(de)(de)(de)(de)先決條件(jian)。我國公民(min)(min)的(de)(de)(de)(de)(de)(de)人(ren)(ren)(ren)(ren)身(shen)自(zi)由(you)(you)(you)(you)受憲法(fa)(fa)和(he)法(fa)(fa)律的(de)(de)(de)(de)(de)(de)保護,憲法(fa)(fa)第三十(shi)七條規定(ding):“中華人(ren)(ren)(ren)(ren)民(min)(min)共和(he)國公民(min)(min)的(de)(de)(de)(de)(de)(de)人(ren)(ren)(ren)(ren)身(shen)自(zi)由(you)(you)(you)(you)不(bu)(bu)受侵(qin)犯。任(ren)何公民(min)(min),非(fei)經人(ren)(ren)(ren)(ren)民(min)(min)檢(jian)察(cha)院批準或(huo)者(zhe)(zhe)決定(ding)或(huo)者(zhe)(zhe)人(ren)(ren)(ren)(ren)民(min)(min)法(fa)(fa)院同(tong)意,并(bing)由(you)(you)(you)(you)公安機關(guan)(guan)執行(xing),不(bu)(bu)受逮(dai)捕(bu)。禁(jin)止非(fei)法(fa)(fa)拘禁(jin)和(he)以(yi)其(qi)他(ta)(ta)方(fang)法(fa)(fa)剝奪或(huo)者(zhe)(zhe)限制公民(min)(min)的(de)(de)(de)(de)(de)(de)人(ren)(ren)(ren)(ren)身(shen)自(zi)由(you)(you)(you)(you)。”為了(le)落實(shi)上(shang)述權(quan)(quan)利,我國刑法(fa)(fa)、刑事訴(su)訟法(fa)(fa)等嚴格規定(ding)了(le)逮(dai)捕(bu)、拘留人(ren)(ren)(ren)(ren)犯的(de)(de)(de)(de)(de)(de)條件(jian)和(he)程(cheng)序(xu)。企業采取強(qiang)迫勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe),如(ru)把勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)非(fei)法(fa)(fa)拘禁(jin)在(zai)(zai)特寫的(de)(de)(de)(de)(de)(de)場(chang)所,強(qiang)迫其(qi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong),否則不(bu)(bu)讓(rang)他(ta)(ta)出來 ,是(shi)(shi)(shi)非(fei)法(fa)(fa)的(de)(de)(de)(de)(de)(de),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)有權(quan)(quan)隨時(shi)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong),并(bing)可(ke)(ke)以(yi)通過有關(guan)(guan)機關(guan)(guan)追究直接責任(ren)人(ren)(ren)(ren)(ren)的(de)(de)(de)(de)(de)(de)責任(ren)。 (3)用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)應盡的(de)(de)(de)(de)(de)(de)義務。如(ru)果用(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)未按(an)照國家(jia)規定(ding)的(de)(de)(de)(de)(de)(de)標準或(huo)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)(de)(de)(de)(de)(de)規定(ding)提供勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)條件(jian),致(zhi)使勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)安全、勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)衛(wei)生條件(jian)惡劣,嚴重危害職工(gong)(gong)的(de)(de)(de)(de)(de)(de)身(shen)體健(jian)康,并(bing)得到國家(jia)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)部(bu)門(men)、衛(wei)生部(bu)門(men)的(de)(de)(de)(de)(de)(de)確認,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)也有權(quan)(quan)提出解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)。
