請問下用人單位可以隨意辭退試用期員工嗎?

答 不(bu)是你想的這樣的,《勞(lao)動(dong)(dong)(dong)合(he)同法》規定,在(zai)試(shi)用期中,用人(ren)(ren)單(dan)位(wei)(wei)證明(ming)勞(lao)動(dong)(dong)(dong)者(zhe)存在(zai)不(bu)符合(he)錄(lu)用條件(jian)、嚴重(zhong)違紀、嚴重(zhong)失(shi)職(zhi)、勞(lao)動(dong)(dong)(dong)合(he)同無(wu)效等法定解除情形(xing),才能依法解除試(shi)用期職(zhi)工,否則(ze),用人(ren)(ren)單(dan)位(wei)(wei)不(bu)得解除勞(lao)動(dong)(dong)(dong)合(he)同。用人(ren)(ren)單(dan)位(wei)(wei)在(zai)試(shi)用期解除勞(lao)動(dong)(dong)(dong)合(he)同的,還應(ying)當向勞(lao)動(dong)(dong)(dong)者(zhe)說明(ming)理由。如果用人(ren)(ren)單(dan)位(wei)(wei)不(bu)能證明(ming)勞(lao)動(dong)(dong)(dong)者(zhe)“不(bu)符合(he)錄(lu)用條件(jian)”而(er)隨意解除勞(lao)動(dong)(dong)(dong)合(he)同,屬于違法解除,勞(lao)動(dong)(dong)(dong)者(zhe)有權依法要求用人(ren)(ren)單(dan)位(wei)(wei)支(zhi)付賠償(chang)金。所以不(bu)要太(tai)緊(jin)張,做(zuo)好(hao)自(zi)己(ji)的本職(zhi)工作就(jiu)可以了(le)。
