合同中對勞動報酬約定不清怎么辦?
問 我(wo)(wo)是一名(ming)剛剛找到工(gong)作(zuo)的應(ying)屆生(sheng),現在正(zheng)在濟南工(gong)作(zuo),兩個(ge)月前公(gong)司和我(wo)(wo)們簽的合同中沒(mei)有明確的說(shuo)明我(wo)(wo)們一個(ge)月多少錢,勞動合同中對勞動報酬約(yue)定不清(qing)怎么辦?
答(da) 《勞(lao)(lao)動(dong)(dong)合(he)(he)同法》第18條規(gui)定(ding)(ding):“勞(lao)(lao)動(dong)(dong)合(he)(he)同對勞(lao)(lao)動(dong)(dong)報酬和勞(lao)(lao)動(dong)(dong)條件(jian)等(deng)標準(zhun)約定(ding)(ding)不明確,引發爭(zheng)議的,用(yong)人單位與(yu)勞(lao)(lao)動(dong)(dong)者可以重新協商;協商不成的,適用(yong)集(ji)體(ti)合(he)(he)同規(gui)定(ding)(ding);沒(mei)有集(ji)體(ti)合(he)(he)同或者集(ji)體(ti)合(he)(he)同未(wei)規(gui)定(ding)(ding)勞(lao)(lao)動(dong)(dong)報酬的,實行(xing)同工同酬;沒(mei)有集(ji)體(ti)合(he)(he)同或者集(ji)體(ti)合(he)(he)同未(wei)規(gui)定(ding)(ding)勞(lao)(lao)動(dong)(dong)條件(jian)等(deng)標準(zhun)的,適用(yong)國家(jia)有關規(gui)定(ding)(ding)。”
