合同中對勞動報酬約定不清怎么辦?
問 我(wo)是一名(ming)剛剛找到工作(zuo)的(de)(de)應(ying)屆生,現在(zai)正(zheng)在(zai)濟南工作(zuo),兩個月前公司和我(wo)們簽的(de)(de)合同(tong)中(zhong)沒有明確的(de)(de)說(shuo)明我(wo)們一個月多少(shao)錢(qian),勞動合同(tong)中(zhong)對勞動報酬(chou)約定(ding)不清(qing)怎(zen)么(me)辦?
答 《勞動(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法》第(di)18條規(gui)定(ding):“勞動(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)對勞動(dong)報(bao)酬和勞動(dong)條件(jian)等標準約(yue)定(ding)不(bu)明確,引發爭議的,用(yong)人單位與勞動(dong)者可以重(zhong)新協商;協商不(bu)成的,適用(yong)集(ji)(ji)(ji)體(ti)合(he)(he)(he)(he)同(tong)(tong)(tong)規(gui)定(ding);沒有集(ji)(ji)(ji)體(ti)合(he)(he)(he)(he)同(tong)(tong)(tong)或(huo)者集(ji)(ji)(ji)體(ti)合(he)(he)(he)(he)同(tong)(tong)(tong)未規(gui)定(ding)勞動(dong)報(bao)酬的,實行同(tong)(tong)(tong)工同(tong)(tong)(tong)酬;沒有集(ji)(ji)(ji)體(ti)合(he)(he)(he)(he)同(tong)(tong)(tong)或(huo)者集(ji)(ji)(ji)體(ti)合(he)(he)(he)(he)同(tong)(tong)(tong)未規(gui)定(ding)勞動(dong)條件(jian)等標準的,適用(yong)國家有關規(gui)定(ding)。”
