高校畢業生如何與用人單位訂立勞動合同?

答 勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)法第(di)(di)七條規定(ding),用(yong)人單位(wei)自(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日起即與(yu)勞(lao)(lao)(lao)動(dong)者建立(li)(li)勞(lao)(lao)(lao)動(dong)關系。第(di)(di)十條規定(ding),建立(li)(li)勞(lao)(lao)(lao)動(dong)關系,應(ying)當訂(ding)立(li)(li)書面(mian)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)。已建立(li)(li)勞(lao)(lao)(lao)動(dong)關系,未(wei)同(tong)時訂(ding)立(li)(li)書面(mian)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)的,應(ying)當自(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日起一個月內訂(ding)立(li)(li)書面(mian)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)。用(yong)人單位(wei)與(yu)勞(lao)(lao)(lao)動(dong)者在用(yong)工(gong)(gong)前訂(ding)立(li)(li)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)的,勞(lao)(lao)(lao)動(dong)關系自(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日起建立(li)(li)。
