試用期合同能否單獨簽?
問 現(xian)在還(huan)在試用(yong)(yong)期,在試用(yong)(yong)期當中(zhong)我可以(yi)跟用(yong)(yong)人單(dan)位單(dan)獨簽約嗎,勞動法有規定嗎?
答 《勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)》第(di)19條(tiao)第(di)4款規(gui)定(ding)(ding):“試(shi)用(yong)期(qi)(qi)包含在(zai)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)限內。勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)僅約定(ding)(ding)試(shi)用(yong)期(qi)(qi)的,試(shi)用(yong)期(qi)(qi)不(bu)成立(li),該期(qi)(qi)限為勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)限。”第(di)46條(tiao)第(di)5項的規(gui)定(ding)(ding):除用(yong)人單(dan)位維持或(huo)者提高勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)約定(ding)(ding)條(tiao)件續訂(ding)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong),勞(lao)動(dong)(dong)者不(bu)同(tong)(tong)(tong)意續訂(ding)的情形(xing)外(wai),依(yi)照(zhao)本法(fa)第(di)44條(tiao)第(di)1項規(gui)定(ding)(ding)終止固定(ding)(ding)期(qi)(qi)限勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的,應(ying)(ying)支付(fu)經濟(ji)補(bu)償(chang)。 其實(shi)是不(bu)能這么(me)做的,如(ru)果這么(me)做,當企業(ye)要(yao)解除合(he)同(tong)(tong)(tong)時,你往往得不(bu)到你應(ying)(ying)有(you)的經濟(ji)賠償(chang)。
