試用期不簽勞動合同合法嗎?

答 很多(duo)企業在(zai)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)內不給(gei)(gei)予(yu)勞(lao)動(dong)(dong)者簽(qian)訂(ding)合同(tong),大多(duo)數都是要(yao)求通過試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)后才(cai)給(gei)(gei)予(yu)簽(qian)訂(ding)。 但在(zai)《勞(lao)動(dong)(dong)合同(tong)法》第十九條有明確規定“試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)包含在(zai)勞(lao)動(dong)(dong)合同(tong)期(qi)(qi)(qi)限內。勞(lao)動(dong)(dong)合同(tong)僅(jin)約定試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的,試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不成(cheng)立,該(gai)期(qi)(qi)(qi)限為(wei)勞(lao)動(dong)(dong)合同(tong)期(qi)(qi)(qi)限。”所(suo)以在(zai)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)也要(yao)簽(qian)訂(ding)勞(lao)動(dong)(dong)合同(tong)。
